Compliance Corner: Non-Compete Clause Rule
The FTC’s non-compete ban is still set to take effect September 4, despite legal challenges. The final rule prohibits employers from entering into new noncompetes and also invalidates existing noncompetes except for those with senior executives – those making over $151,164 and in a policymaking position. For employees who are not senior executives, employers must provide a notice by September 4 letting them know existing noncompetes are no longer enforceable.
